1. Introduction

Before using the LingoLeap application and website (the "Service"), please read the following Terms of Use carefully. This document is a binding agreement between you (as the user) and LingoLeap ("we", "us", "our", "our company").

By accessing or using our Service, you accept these terms and conditions. If you do not agree to these terms, please stop using our Service.

2. Account Creation and Security

You may need to create an account in order to use LingoLeap services. The terms relating to the creation and use of an account are as follows:

You undertake that all the information you provide when creating an account is accurate, up to date and complete.
You alone are responsible for the security of your account. You are expected to use a strong password and to keep your password confidential.
You are responsible for all activities that take place in your account. If you notice any unauthorised access to your account, you must contact us immediately.
You must not share your account information with others, and an account must not be used by more than one person.
An account may not be created for persons under the age of 13 without the consent of a parent or legal guardian.
By creating an account, you agree that you will receive notifications, updates and other information about the service.

3. Membership and Payment Terms

LingoLeap offers various membership plans and content purchase options:

3.1. Membership Plans

LingoLeap offers the following automatically renewing subscription plans:

Monthly Premium Package: For a fee of ₺79.99 per month, renews automatically every month.
6-Month Premium Package: For a fee of ₺399.99, renews automatically every 6 months.
1-Year Premium Package: For a fee of ₺699.99, renews automatically every year.

All premium packages include:

Unlimited word learning
Ad-free experience
Access to advanced-level content
Special educational materials
Access to all premium features

LingoLeap offers free and premium (paid) membership options. Premium membership features and fees may change over time.
Premium membership subscriptions are automatically renewing subscriptions and, unless cancelled, renew automatically at the end of the selected period (monthly, 6-month, yearly).
By completing the purchase, you agree that your subscription will renew automatically and that the applicable fees will be charged to your credit card or your preferred payment method.
Subscriptions will be charged to your iTunes account at the time of purchase. A subscription will renew automatically unless it is cancelled at least 24 hours before the end of the subscription period.
Payment transactions are subject to the terms of the selected payment provider (Apple App Store, Google Play Store, etc.).
Cancellations can be made within the application or through the payment provider's platform (account settings). Your subscription will remain active until the end of the current billing period.
For Apple devices: To manage or cancel your subscription, go to your iTunes account settings.

3.2. Gold Sales and Virtual Items

You can purchase "Gold", a virtual currency that can be used within the LingoLeap application.
A Gold purchase is a one-time payment and is not a subscription.
Gold and other virtual items can be used only within the LingoLeap application and cannot be converted into real currency.
Purchased Gold and virtual items are for personal use and cannot be transferred, sold or assigned to third parties.
LingoLeap reserves the right to change the prices, availability or functionality of virtual items without prior notice.
If Gold or virtual items are lost as a result of an error or technical problem, you must report the situation to customer service as soon as possible.

3.3. Refund Policy

All payment transactions are subject to the refund policies of the relevant app store (Apple App Store, Google Play Store).
Refund requests for subscription payments or Gold purchases must be made through the relevant app store.
Refunds are generally not given for used or partially used Gold.
In exceptional cases, we may consider your refund requests for the sake of customer satisfaction; however, we do not guarantee a refund in every case.
Uninstalling the application or deleting your account does not automatically cancel your active subscriptions. You must cancel your subscription manually.

3.4. Price Changes

LingoLeap reserves the right to change the prices of its products and services at any time.
Price changes do not affect the current subscription period and take effect from the next renewal period.
You will be informed in advance of significant changes to the subscription price.

4. Rules of Use and Restrictions

You agree to comply with the following rules when using the LingoLeap service:

You undertake to use the Service lawfully and in accordance with these Terms of Use.
In using the Service, you may not violate the rights of others or harass, threaten or harm others.
You may not use the Service to create, share or store content or material that is illegal, harmful, misleading, degrading, obscene or otherwise inappropriate.
You may not engage in any activity that disrupts, obstructs or adversely affects the normal operation of the Service.
Without LingoLeap's written permission, you may not use the Service by means of automated or robotic technologies or carry out "data scraping".
You may not copy, modify, distribute, sell or rent any part of the Service.
You may not transfer your account or the service to others or allow others to use your account.
You may not reverse engineer, decompile or disassemble the Service.

5. Intellectual Property Rights

The intellectual property rights relating to LingoLeap and its content are governed as follows:

The LingoLeap application, website and all of their content (text, graphics, logos, audio files, buttons, images, software, learning materials, etc.) belong to LingoLeap or its licensors and are protected by copyright, trademark and other intellectual property rights.
Your use of the Service does not grant you any rights in respect of LingoLeap's intellectual property.
You may use LingoLeap content only for personal, non-commercial purposes and in accordance with these Terms of Use.
You do not have the right to copy, modify, distribute, sell, rent, lend, publicly perform or display, adapt or reproduce the content or materials, or to create derivative works from them.

6. User Content

The terms relating to content created by users are as follows:

You are responsible for all content (notes, comments, feedback, etc.) that you submit, upload or otherwise share on the Service.
You undertake that the content you share complies with the law and does not violate the rights of third parties.
You grant LingoLeap a worldwide, non-exclusive, royalty-free, fully paid-up and sublicensable licence to use, modify, adapt, reproduce, distribute and display the content you share.
LingoLeap reserves the right, at its own discretion, to remove content that is inappropriate or that violates these Terms of Use.

7. Account Suspension and Termination

LingoLeap reserves the right to suspend or terminate user accounts in the following cases:

In the event of any violation of these Terms of Use.
In the event of conduct that violates the rights of third parties or that is threatening, harassing, degrading or illegal.
Unauthorised access to other users' accounts or personal data.
Misuse of the Service through automated systems (use of bots, data scraping, etc.).
Attempts to manipulate the in-app economy or the scoring system.
Providing false identity information or creating more than one account.
In the event of account termination, any refund of fees paid up to that point is entirely at LingoLeap's discretion.
When your account is terminated, you lose your right of access to all of your virtual items, including Gold, and no refund is given for them.

8. Third-Party Services and Links

LingoLeap sets out the following terms in relation to third-party services:

Our Service may contain links to websites, applications or services belonging to third parties.
We are not responsible for the content, privacy policies or practices of these third-party services.
Your use of third-party services is subject to those services' own terms of use and privacy policies.
Payment transactions are carried out by third-party payment processors such as the Apple App Store or Google Play Store, and these transactions are subject to the terms of the relevant payment processor.

9. Disclaimer and Warranties

What you need to know about liability and warranties in relation to LingoLeap services:

Our Service is provided "as is" and "as available", without any warranty.
LingoLeap does not warrant that the service will be uninterrupted, error-free or secure.
LingoLeap does not warrant the accuracy, reliability or any other characteristic of the results obtained through the service.
LingoLeap gives no guarantee whatsoever regarding learning outcomes or the attainment of language proficiency.
To the extent permitted by law, LingoLeap disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of Liability

LingoLeap's limitations of liability are as follows:

To the maximum extent permitted by law, LingoLeap, its directors, employees, partners or agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use of, or inability to use, the service.
LingoLeap's total liability shall in no event exceed the amount you have paid for the service within the last 12 months.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages; therefore, the above limitations may not apply to you.

11. Indemnification

Indemnification obligations relating to your use of LingoLeap services:

You agree to defend, indemnify and hold harmless LingoLeap, its directors, employees and agents against any and all claims, demands, damages, liabilities and expenses (including reasonable lawyers' fees) arising from your use of the Service, your violation of these Terms of Use or your violation of the rights of another user or a third party.

12. Governing Law and Dispute Resolution

Terms relating to legal matters and the resolution of disputes:

These Terms of Use are governed by, and shall be construed in accordance with, the laws of the Republic of Türkiye.
Any dispute arising out of or in connection with these Terms of Use or the use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Türkiye.
In the event of any dispute, you agree to try to resolve the matter amicably before filing a lawsuit.

13. Changes

LingoLeap reserves the right to change these Terms of Use at any time. Your continued use of the service after the changes have been published means that you accept the updated terms.

When there are significant changes, we will inform you by email, by in-app notification or by publishing a notice on our website.

14. General Provisions

Waiver: LingoLeap's failure to enforce any right or provision of these Terms of Use does not mean that the right or provision has been waived.
Severability: If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms of Use represent the entire agreement between you and LingoLeap with respect to the service and supersede all prior agreements, proposals and representations.
Assignment: You may not assign your rights and obligations under this agreement without LingoLeap's written consent.
Force Majeure: LingoLeap shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, terrorism, war, rebellion, strikes, government actions and Internet failures.

15. Apple App Store EULA and Legal Links

On iOS devices, the LingoLeap application is distributed through the Apple App Store, and the following legal documents also apply:

In the event of a conflict between these terms of use and Apple's standard EULA, Apple's EULA shall prevail
